Use of the Site

Use of this Site and its Content is permitted for lawful purposes, including general informational use and accessing the EverCurrent platform and related Services. We reserve the right to modify, update, suspend, or discontinue any part of the Site, Content, or Services at any time without prior notice.

The Content on this Site is provided for informational purposes only, does not constitute a contractual offer or commitment by EverCurrent, and may not be relied upon for making business, legal, or technical decisions. References to third-party products, services, or organizations are provided solely for convenience and do not constitute or imply an endorsement, sponsorship, or recommendation by EverCurrent.

Intellectual Property

All Content on the Site, including but not limited to text, graphics, logos, icons, images, software, audio or video materials, and trademarks, is the property of EverCurrent or our licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Except as expressly authorized in writing by EverCurrent, you may not copy, reproduce, modify, adapt, translate, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any Content, in whole or in part. You may download or print a reasonable number of copies of publicly available materials solely for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices contained therein. All rights not expressly granted are reserved.

User Content and AI Output

If you provide data, text, files, or other materials to the EverCurrent platform (“Input”), you retain all ownership rights in that Input. Subject to your compliance with these Terms, we assign to you all right, title, and interest in and to the specific output generated by the platform based on your Input (“Output”). You are solely responsible for how you use Output and for ensuring it complies with applicable laws and regulations.

By submitting Input, you grant EverCurrent a non-exclusive, worldwide, royalty-free license to host, process, store, reproduce, and use your Input and Output as necessary to operate, maintain, improve, and secure the Services, develop new features, and comply with legal obligations.

Because of the nature of artificial intelligence and machine learning, similar or identical Output may be generated for other users based on different inputs. Output is generated automatically and may contain inaccuracies, and you should independently review and validate any Output before relying on it.

Metadata and Analytics

We may collect and use aggregated and anonymized usage data (“Metadata”)—such as feature usage patterns, performance metrics, and technical logs—to operate, maintain, analyze, and improve the Services. Metadata does not identify you, your organization, or your specific Content. Where required by law, we will obtain any necessary consent before collecting certain types of Metadata.

You may opt out of non-essential Metadata collection by providing written notice to info@evercurrent.ai within 30 days of accepting these Terms. Please note that opting out may limit functionality, reduce personalization, or affect the performance of certain features.

Prohibited Uses

You may not:

• Use the Site or Services for unlawful, infringing, or harmful purposes.
• Attempt to access source code, bypass security, or disrupt the Site.
• Upload or transmit content that violates the rights of others.

Third-Party Content

The Site may contain links to, or integrations with, third-party websites, applications, or services (“Third-Party Services”). These are provided for convenience only. EverCurrent does not control, endorse, or assume any responsibility for the content, functionality, terms of use, privacy policies, or practices of any Third-Party Services. Your interactions with Third-Party Services are solely between you and the applicable third party, and your use of them is at your own risk. We are not liable for any loss or damage arising from your access to or use of Third-Party Services. You should review the applicable terms and privacy policies before using any Third-Party Service.

No Warranties

Unless otherwise expressly stated in writing, the Site, Content, and Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, EverCurrent disclaims all warranties, including but not limited to implied warranties of merchantability, non-infringement, fitness for a particular purpose, title, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site, Content, or Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. You assume all risk for your use of the Site, Content, and Services.

Limitation of Liability

To the maximum extent permitted by applicable law, EverCurrent will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Site, Content, or Services, even if we have been advised of the possibility of such damages. In no event will EverCurrent's total cumulative liability for all claims arising from or related to the Site, Content, or Services exceed one hundred U.S. dollars (US $100). These limitations apply to all causes of action, whether based on contract, tort (including negligence), strict liability, or any other legal theory, and will survive any termination of these Terms.

Compliance with Laws

You are solely responsible for complying with all applicable laws, regulations, and industry standards in connection with your access to and use of the Site, Content, and Services. This includes, without limitation, compliance with export control and economic sanctions laws, privacy and data protection regulations, and any local laws applicable in the jurisdiction from which you access the Services. You represent and warrant that you are not located in, under the control of, or a resident or national of any country or region subject to comprehensive U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

Changes to Terms

We may update or modify these Terms from time to time at our discretion. If we make material changes, we will post the updated Terms on the Site and update the “Last Updated” date at the top of this page. In certain cases, we may also provide additional notice (such as by email or within the Services). Governing Law

These Terms and any dispute or claim arising out of or relating to them, the Site, or the Services will be governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Alameda County, California, and waive any objection to jurisdiction, venue, or inconvenient forum in such courts.
